  5. CONSENT FROM THE AUTHOR.

  7. Noncommercial distribution and/or use is permitted under the
  8. following terms:

  10. 1)   You may copy and distribute verbatim copies of the Mangler
  11.      source, documentation, and executable code as you receive
  12.      it, in any medium, provided that you conspicuously and
  13.      appropriately publish on each copy a valid copyright notice
  14.      "Copyright 1993 by Berend de Boer"; keep intact the notices
  15.      on all files that refer to this Licence Agreement and to the
  16.      absence of any warranty;  PROVIDE UNMODIFIED COPIES OF THE
  17.      DOCUMENTATION AS PROVIDED WITH THE PROGRAM; and give any
  18.      other recipients of the Mangler program a copy of this
  19.      Licence Agreement along with the program.  You may charge a
  20.      distribution fee for the physical act of transferring a
  21.      copy, but no more than is necessary to recover your actual
  22.      costs incurred in the transfer. Under no circumstances is
  23.      Mangler to be distributed in such a way as to be construed as
  24.      "value added" in a sales transaction, such as, but not
  25.      limited to, software bundled with a modem or CD-ROM software
  26.      collections, without the prior written consent of the
  27.      author.

  29. 2)   You may modify your copy or copies of Mangler  or any portion
  30.      of it, and copy and distribute such modifications under the
  31.      terms of Paragraph 1 above, provided that you also do the
  32.      following:

  34.      a) cause the modified files to carry prominent notices
  35.      stating that you changed the files and the date of any
  36.      change;
  37.  
  38.      b) cause the executable code of such modified version to
  39.      clearly identify itself as such in the course of its normal
  40.      operation;
  41.  
  42.      c) if the modified version is not a "port", but operates in
  43.      the same hardware and/or software environment as the
  44.      original distribution, make the original version equally
  45.      available, clearly identifying same as the original,
  46.      unmodified version;
  47.  
  48.      d) cause the whole of any work that you distribute or
  49.      publish, that in whole or in part contains or is a
  50.      derivative of Mangler or any part thereof, to be licensed at
  51.      no charge to all third parties on terms identical to those
  52.      contained in this Licence Agreement (except that you may
  53.      choose to grant more extensive warranty protection to some
  54.      or all third parties, at your option); and:

  56.      e) send the complete source code modifications to Berend de
  57.      Boer at the addresses listed below,  for the purpose of
  58.      evaluation for inclusion in future releases of Mangler.
  59.      Should your source code be included in Mangler, Berend de
  60.      Boer retains all rights for redistribution of the code as
  61.      part of Mangler and all derivative works, with appropriate
  62.      credit given to the author of the modification;
  63.  
  64.      f) You may charge a distribution fee for the physical act of
  65.      transferring a copy, but no more than is necessary to
  66.      recover your actual costs incurred in the transfer, and you
  67.      may at your option offer warranty protection in exchange for
  68.      a fee;
  69.  
  70.      g) when distributing modified versions of Mangler, you must
  71.      not change the name of the program or the official version
  72.      number, except to append an identifier which indicates that
  73.      modifications have been made.  For ports to other operating
  74.      systems, the following convention must be followed:

  76.           Mangler v<v>.<os>.R<r>
  77.  
  78.      ...where <v> is the official Mangler version number, <os> is
  79.      the name of the operating system which the port runs under,
  80.      and <r> (optional) is the OS-specific revision number.  For
  81.      example, the second OS/2 revision of Mangler 1.02 must have a
  82.      version string in this format:  `Mangler v1.02.OS/2.R2'
  83.  
  84.      Similarly, modifications to Mangler which are designed to run
  85.      under MS-DOS must also follow a naming convention.  The
  86.      version string must read:
  87.  
  88.           Mangler v<v>.<i>.<r>
  89.  
  90.      where <v> is the official Mangler version number, <i> is
  91.      three initials (indicating your first, middle and last
  92.      names), and <r> (optional) is the revision number of your
  93.      modifications.
  94.  
  95.      For example, a version of Mangler 2.00 modified by Joe T.
  96.      Hacker must have a version string in this format: `Mangler
  97.      v2.00.jth.1'
  98.  
  99. 3)   Mere aggregation of another unrelated program with this
  100.      program and documentation (or derivative works) on a volume
  101.      of a storage or distribution medium does not bring the other
  102.      program under the scope of these terms.

  104. 4)   You may copy and distribute Mangler and its associated
  105.      documentation (or a portion or derivative of it, under
  106.      Paragraph 2) in object code or executable form under the
  107.      terms of Paragraphs 1 and 2 above provided that you also do
  108.      one of the following:
  109.  
  110.      a) accompany it with the complete corresponding
  111.      machine-readable source code, which must be distributed
  112.      under the terms of Paragraphs 1 and 2 above; or,
  113.  
  114.      b) accompany it with a written offer, valid for at least
  115.      three years, to give any third party free (except for a
  116.      nominal shipping charge) a complete machine-readable copy of
  117.      the corresponding source code, to be distributed under the
  118.      terms of Paragraphs 1 and 2 above; or,
  119.  
  120.      c) accompany it with the information you received as to
  121.      where the corresponding source code may be obtained. (This
  122.      alternative is allowed only for noncommercial distribution
  123.      and only if you received the program in object code or
  124.      executable form alone.)

  126.      For an executable file, complete source code means  all the
  127.      source code for all modules it contains; but, as a special
  128.      exception, it need not include source code for modules which
  129.      are standard libraries that accompany the operating system
  130.      on which the executable file runs.

  132. 5)   You may not copy, sublicense, distribute or transfer Mangler
  133.      and its associated documentation except as expressly
  134.      provided under this Licence Agreement.  Any attempt
  135.      otherwise to copy, sublicense, distribute or transfer Mangler
  136.      is void and your rights to use the program under this
  137.      Licence agreement shall be automatically terminated.

  139.      However, parties who have received computer software
  140.      programs from you with this Licence Agreement will not have
  141.      their licences terminated so long as such parties remain in
  142.      full compliance, and notify Berend de Boer of their
  143.      intention to comply with this Agreement.
  144.  
  145. 6)   You may not incorporate parts of Mangler into a program
  146.      which is NOT completely free for ALL users. If you wish to
  147.      use Mangler in such a way, you must obtain written
  148.      permission from Berend de Boer before using any of the
  149.      Mangler code.
  150.  
  151. 7)   You may not incorporate parts of Mangler into a FUNCTIONALLY
  152.      SIMILAR program, including other manglers or programmer tool
  153.      packages.
  154.  
  155. 8)   The privileges granted above apply only to noncommercial
  156.      users of the Mangler software.  You are a NONCOMMERCIAL user
  157.      only if you are running Mangler a private individual with no
  158.      "sponsors", "backers" or if you use it for public domain or
  159.      shareware programs.. You are a COMMERCIAL user if you develop
  160.      and distribute commercial programs.
  161.  
  162.      This licence only governs NONCOMMERCIAL users.  If you are a
  163.      COMMERCIAL user, you are not licensed to use or distribute
  164.      this software without the prior written consent of Berend de
  165.      Boer.  If you wish to use Mangler as a commercial
  166.      user, please write Berend de Boer to negotiate a site
  167.      license.

  169. 9)   This licence may be revoked by Berend de Boer without prior
  170.      notice.

  172.                            NO WARRANTY
  173.  
  174. BECAUSE MANGLER IS LICENSED FREE OF CHARGE, WE PROVIDE ABSOLUTELY
  175. NO WARRANTY.  EXCEPT WHEN OTHERWISE STATED IN WRITING, BEREND DE
  176. BOER AND/OR OTHER PARTIES PROVIDE MANGLER "AS IS" WITHOUT
  177. WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT
  178. NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND
  179. FITNESS FOR A  PARTICULAR PURPOSE.  THE ENTIRE RISK AS TO THE
  180. QUALITY AND PERFORMANCE OF MANGLER, AND THE ACCURACY OF ITS
  181. ASSOCIATED DOCUMENTATION, IS WITH YOU.  SHOULD MANGLER OR ITS
  182. ASSOCIATED DOCUMENTATION PROVE DEFECTIVE, YOU ASSUME THE COST OF
  183. ALL NECESSARY SERVICING, REPAIR OR CORRECTION.
  184.  
  185. IN NO EVENT WILL BEREND DE BOER BE RESPONSIBLE IN ANY WAY FOR THE
  186. BEHAVIOUR OF MODIFIED VERSIONS OF MANGLER. IN NO EVENT WILL
  187. BEREND DE BOER AND/OR ANY OTHER PARTY WHO MAY MODIFY AND
  188. REDISTRIBUTE MANGLER AS PERMITTED ABOVE, BE LIABLE TO YOU FOR
  189. DAMAGES, INCLUDING ANY LOST PROFITS, LOST MONIES, OR OTHER
  190. SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE
  191. USE OR INABILITY TO USE (INCLUDING BUT NOT LIMITED TO LOSS OF
  192. DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY
  193. THIRD PARTIES OR A FAILURE OF THE PROGRAM TO OPERATE WITH ANY
  194. OTHER PROGRAMS) MANGLER, EVEN IF BEREND DE BOER HAS BEEN ADVISED
  195. OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER
  196. PARTY.
